Licence ratings, restrictions and enforcement response

Respond to the actual notice and keep business decisions tied to its terms.

Use the correct rating vocabulary

Worker sponsor guidance uses A and B ratings, with a provisional category for certain UK Expansion Worker sponsors. Downgrading, suspension and revocation are different actions. Local red/amber/green findings are internal priorities, not official licence ratings.

  • Record the notice, receipt date, response deadline and stated grounds.
  • Identify precisely what activity the notice permits or restricts.
  • Escalate to the Authorising Officer and an appropriately qualified adviser promptly.

Build a factual response file

Recommended practice: separate undisputed facts, disputed findings, supporting evidence and corrective action.

  • Preserve originals and a clear evidence chronology.
  • Protect affected workers from inaccurate promises about their immigration position.
  • Track formal submissions and deadlines independently of the remediation task list.
  • Retest fixes and retain proof of who checked them.

Suggested notice-to-action schedule

Read the notice as a whole and create a schedule of allegations, restrictions, requested evidence and response dates. Preserve the original correspondence and how it was received. Identify the decision owner for each item, the evidence location and the questions requiring specialist advice. Keep business-continuity decisions tied to the actual terms rather than assumptions about a familiar enforcement label.

Use a separate submission tracker for review, approval and delivery. Internal remediation can continue alongside it, but completing an improvement task does not demonstrate that a formal response was submitted.

  • Assign one person to control the authoritative chronology and document version.
  • Record how every relevant deadline was identified and who monitors it.
  • Preserve delivery evidence and any subsequent clarification from the authority.

Suggested evidence and communications review

For each disputed point, identify the contemporaneous material that supports the organisation's account and any fact that remains uncertain. Separate an explanation of the past from a proposal to improve the future. Where the evidence confirms a problem, document its scope and the checks used to establish whether it affects other cases.

Prepare worker and manager communications around confirmed facts and the decisions they need to make. Have sensitive messages reviewed by the appropriate adviser. Avoid promises about immigration permission, travel, future assignments or licence restoration that the organisation cannot substantiate from the actual position.

Fictional practice scenario

A fictional sponsor receives a notice raising concerns about payroll and record availability. One manager wants to respond with a newly written policy. The response team first maps each allegation to the relevant historic records and identifies what the policy change can and cannot demonstrate.

The exercise produces an evidence schedule, a controlled response timetable and a distinct remediation plan. It does not predict how UKVI will decide the case or whether a particular remedy will be accepted.
